1. Acceptance of Terms

By accessing or using ProWebsiteDesigners.com ("the Site") you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Site.

2. Description of Service

ProWebsiteDesigners.com is a free lead-matching service that connects businesses seeking web design services with pre-screened web designers and agencies ("Partner Companies"). ProWebsiteDesigners.com is a service that is owned and operated by MountainView Development and Marketing. Any agreement made with a Partner Company is separate from the terms, conditions, and policies for ProWebsiteDesigners.com.

3. Free Service for Users

The Site is provided at no cost to businesses and individuals seeking web design services. Submitting a quote request creates no obligation to hire any designer. You are free to compare quotes and choose the designer that best fits your needs and budget.

4. Consent to Be Contacted

By submitting a quote request, you expressly consent to be contacted by our Partner Companies via phone, text message, or email regarding the web design services you requested. This contact may include automated or pre-recorded messages. You may opt out of further contact from any specific designer at any time by informing them directly.

While we make an effort to partner with responsible service providers, ProWebsiteDesigners.com (MountainView Development and Marketing) is not responsible for their actions, including, but not limited to, unwanted additional contact and solicitations. If it comes to our attention that a Partner Company is behaving irresponsibly, we will review the case and reserve the right to terminate their account.

5. Information Sharing

The personal information you provide — including your name, phone number, and project details — will be shared with Partner Companies in our network for the sole purpose of preparing and delivering web design quotes. See our Privacy Policy for full details.

6. Accuracy of Information

You agree to provide accurate and truthful information when submitting a quote request. Submitting false or misleading information may result in your request being disqualified.

7. No Endorsement of Designers

While we vet all Partner Companies, we do not guarantee the quality, safety, or results of any work performed by them. Any contract for services is strictly between you and the designer you choose. We encourage you to review portfolios, verify credentials, and obtain written contracts before making a decision.

8. Limitation of Liability

ProWebsiteDesigners.com is not liable for any damages arising from your use of the Site, the quotes you receive, or any work performed by a Partner Company. Our service is provided "as is" without warranties of any kind.

9. Intellectual Property

All content on this Site, including text, graphics, and logos, is the property of ProWebsiteDesigners.com or its content suppliers and is protected by applicable intellectual property laws.

10. Changes to Terms

We reserve the right to update these Terms & Conditions at any time. Changes will be posted on this page with an updated effective date. Continued use of the Site after changes are posted constitutes acceptance of the revised terms.

11. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in accordance with applicable federal and Utah state law.

12. Terms for Partner Companies (Designers, Freelancers & Agencies)

Sections 12 through 18 apply specifically to designers, freelancers, and agencies who enroll as Partner Companies on ProWebsiteDesigners.com. By applying for or maintaining a Partner Company account, you agree to all terms in this section in addition to the general terms above.

13. Partner Company Eligibility & Enrollment

To become a Partner Company, you must complete our application and screening process. Acceptance is granted at our sole discretion. We reserve the right to deny any application, or to suspend or terminate any existing Partner Company account at any time, with or without advance notice, for any reason we deem sufficient — including but not limited to failure to meet our quality standards, violation of these Terms, or conduct that we determine is harmful to users or to the integrity of our platform.

By enrolling, you represent that you are legally authorized to conduct business, that all information you provide during the application process is accurate and complete, and that you will maintain accurate account information for the duration of your enrollment.

14. Partner Company Obligations & Code of Conduct

As a Partner Company, you agree to:

  • Respond to leads promptly and professionally
  • Provide accurate representations of your services, experience, portfolio, and pricing
  • Refrain from misleading, deceptive, high-pressure, or harassing sales tactics of any kind
  • Honor the scope and pricing of any quote or representation you make to a prospective client
  • Maintain a legitimate, active business presence for the duration of your subscription
  • Comply with all applicable federal, state, and local laws, including consumer protection and anti-spam regulations
  • Not share, sell, transfer, or sublicense leads or lead data to any third party outside your own organization
  • Not use lead data for any purpose other than responding to the specific project inquiry for which it was delivered

Violation of any of the above may result in immediate account suspension or termination without refund.

15. Payment, Subscription & Billing

Partner Companies pay a recurring subscription fee, per-lead fee, or other fee structure as described on our pricing or enrollment page at the time of sign-up. All fees are disclosed prior to enrollment. By enrolling, you authorize MountainView Development and Marketing to charge your payment method on the applicable billing cycle until you cancel.

Subscription fees are charged in advance and cover access to the lead-matching platform and associated services for the stated billing period. It is your responsibility to manage your subscription, including cancellation prior to any renewal date. Failure to cancel before a renewal date does not entitle you to a refund for the renewed period.

16. Refund Policy

All refund decisions are made at the sole and exclusive discretion of ProWebsiteDesigners.com (MountainView Development and Marketing). There is no automatic entitlement to a refund, and each request is evaluated individually. Submitting a refund request does not guarantee that one will be issued.

The following circumstances are explicitly not valid grounds for a refund:

  • Failure to close a deal or convert a lead into a paying client — lead generation does not guarantee sales outcomes
  • A prospective client not answering calls, texts, or emails, or being otherwise unreachable
  • A prospective client expressing disinterest, changing their mind, or no longer wishing to move forward with a project
  • Dissatisfaction with the budget, scope, timeline, or any other details of a lead after it has been delivered
  • Leads falling outside your preferred niche, service area, or project type when such preferences were not specified or agreed upon prior to enrollment
  • Changes in your business circumstances, including staffing changes, reduced capacity, or a decision to pause or close operations
  • Forgetting to cancel your subscription before the next billing cycle renews
  • Partial use of a subscription period, regardless of how little of the period was used
  • Dissatisfaction with platform results based solely on subjective expectations rather than a documented platform error

We take refund requests seriously and will give them full consideration in cases of documented platform errors, verified duplicate billing, or other extraordinary circumstances. To submit a request, contact us through our Contact page with your account information and a detailed description of the issue. We will respond within a reasonable timeframe. Our decision on any refund request is final.

17. Lead Quality & No Guarantee of Results

ProWebsiteDesigners.com makes reasonable efforts to deliver leads from businesses and individuals who have expressed genuine interest in web design services. However, we make no warranties or guarantees regarding:

  • Whether a lead will respond to your outreach attempts
  • Whether a lead will result in a signed contract or paid engagement
  • The budget, timeline, technical requirements, or scope of any given project
  • The completeness or accuracy of information provided by a prospective client at the time of their inquiry
  • The total number of leads you will receive over any given period

Lead quality concerns must be reported within 7 calendar days of delivery through our Contact page. Reported leads are reviewed at our discretion and may, but will not necessarily, result in a replacement lead or account credit. Unreported leads or reports submitted after the 7-day window will not be considered for replacement or credit.

18. Partner Account Suspension & Termination

We reserve the right to suspend or terminate any Partner Company account, with or without prior notice, for reasons including but not limited to:

  • Violation of any provision of these Terms
  • Fraudulent, abusive, deceptive, or harassing conduct toward leads, users, or our platform
  • Chargebacks or payment disputes filed in bad faith
  • Conduct that damages the reputation, integrity, or trustworthiness of ProWebsiteDesigners.com
  • Non-payment or chronic payment failures

Upon termination, your access to the platform and any unused subscription time, lead credits, or other platform benefits will be forfeited without refund, unless otherwise determined at our sole discretion. Termination does not relieve you of any payment obligations incurred prior to the termination date.

19. Agreement to Receive Text Messages

By providing your mobile number, you agree that MountainView Development and Marketing may send you periodic SMS or MMS messages containing, but not limited to, important information, updates, and service-related communications.

You may unsubscribe at any time by texting the word STOP to the number that contacted you. You may receive a subsequent message confirming your opt-out request.

Message and data rates may apply.

You agree to notify us of any changes to your mobile number and update your account with us to reflect this change.

Data obtained from you in connection with this SMS service may include your cell phone number, your carrier's name, and the date, time, and content of your messages, as well as other information that you provide. We may use this information to contact you and to provide the services you request from us.

By subscribing or otherwise using the service, you acknowledge and agree that we will have the right to change and/or terminate the service at any time, with or without cause and/or advance notice.

Though MountainView Development and Marketing will never charge you for the text messages you receive, depending on your phone plan, you may see charges from your mobile provider. Please reach out to your wireless provider if you have questions about your text or data plan.
